Положения об обязательствах и договорах являются такими институтами римского частного права, которые особенно сильно повлияли на современное гражданское право. В статье подробно рассмотрены происхождение и развитие института contractus societas, т.е. договора товарищества. Данный договор присутствует и в современном российском гражданском законодательстве. В связи с этим исследование института договора товарищества в римском частном праве представляется актуальным. Целью данного исследования является формирование комплексного научного представления о происхождении и развитии института contractus societas, т.е. договора товарищества, в римском частном праве. Задачей исследования является рассмотрение различных разновидностей института contractus societas, таких как societas unius rei, при которой имущество участников было строго обособлено и общей собственности не возникало, а также contractus societas negotiationis, при которой имущество становилось общей собственностью товарищей с момента его приобретения. Научная значимость исследования заключается в выявлении основных характеристик института договора товарищества, подробно урегулированного по самым разнообразным аспектам к моменту кодификации Юстиниана. Практическая значимость исследования состоит в возможности использования его результатов в вопросах изучения римского частного права. Научная новизна исследования состоит в сформированном авторами комплексном научном представлении о происхождении и развитии института договора товарищества.
Provisions on obligations and contracts are such institutions of Roman private law that have particularly strongly influenced modern civil law. In this article examine in detail the origin and development of the institution of contractus societas, i.e. a partnership agreement. This agreement is also present in modern Russian civil legislation. In this regard, the study of the institution of a partnership agreement in Roman private law seems relevant. The purpose of this study is to form a comprehensive scientific understanding of the origin and development of the institution of contractus societas, i.e. a partnership agreement, in Roman private law. The objective of the study is to consider various varieties of the institution of contractus societas, such as societas unius rei, in which the property of the participants was strictly separate and common ownership did not arise, as well as contractus societas negotiationis, in which the property became the common property of the partners from the moment of its acquisition. The scientific significance of the study lies in identifying the main characteristics of the institution of the partnership agreement, which was regulated in detail in a variety of aspects by the time of Justinian's codification. The practical significance of the study lies in the possibility of using its results in studying Roman private law. The scientific novelty of the study lies in the comprehensive scientific understanding of the origin and development of the institution of the partnership agreement formed by the authors.
