Criteria for the Nature and Typical Degree of Public Danger of Environmental Crimes

The paper notes that the establishment of a public danger of an act necessitates the regulation of its prohibition, that is, its criminalization, as well as the differentiation of criminal liability. The main and cross-cutting criteria are its nature and degree. It is indicated that if the criteria of the nature and the average degree of public danger of an act should be taken into account when criminalizing it, then an increased or, conversely, a reduced degree of public danger should be taken into account when differentiating criminal liability. Some features of the nature and degree of public danger of environmental crimes are revealed and an insufficient level of criminal law protection of the environment and its individual components is noted.

Identification and systematization of criteria for the nature and typical degree of public danger of environmental crimes are of fundamental importance for deepening criminalization and differentiation of criminal liability and, accordingly, for solving the tasks of criminal legislation.
