А Compromise in the System of Legal Regulation in the Resolution of Criminal Conflicts

Abstract

Criminal law and criminal procedure methods of regulation in the resolution of criminal law conflicts are becoming increasingly important. Among them, the theory of compromise as a basis and a new paradigm for resolving criminal law conflict attracts attention. The need for encouragement in Russian legislation is possible in exchange for positive post-criminal behavior of the perpetrator, stimulation as a method of motivation. In order to move to a new paradigm of the use of conciliation (contractual) forms in criminal and criminal procedure law, dispositivity should be developed as a method and principle of legal regulation of the resolution of criminal law conflicts.

The purpose of the study is to study the compromise mechanism, as well as possible directions for further improvement of such alternative proceedings in order to quickly resolve the criminal law conflict.

The scientific significance of the work lies in the fact that it reveals the main methods of criminal and criminal procedural regulation in the form of dispositivity, discretionary prosecution, mediation, and principles of justice.

The authors formulate the conclusions and results of the study, namely, an algorithm for reaching a compromise linking mutual rights and obligations is proposed. In order to protect the public interest and stimulate positive post-criminal behavior of the person who committed the crime, it is necessary to implement an algorithm for achieving and implementing a compromise. The proposed compromise is to maximize the stimulation of the post-criminal behavior of the person who committed the crime in exchange for concessions from the investigating authorities.
