Some Problematic Issues of Qualification of Crimes in the Field of Illegal Arms Trafficking

Currently, there is an increase in crimes in the field of illegal arms trafficking in the Russian Federation, more than half of them belong to the category of serious and especially serious. The aim is to develop measures to counteract this negative phenomenon. The tasks are: to identify problems that arise when studying the issues of involving a person in a combination of crimes with related compounds and simultaneously committing actions by a person to acquire, store, carry, transfer and transport firearms, their parts and ammunition; the study of voluntary surrender, the incorrect interpretation of which may lead to a possible refusal to release from criminal liability consideration of the issues of quantitative characteristics of the subjects of crimes in the field of illegal arms trafficking, which can be used both as qualifying signs and as a basis for recognizing an act as insignificant. The scientific and practical significance is due to the fact that the authors have identified gaps in the current legislation in the field of illegal arms trafficking. The main results were proposals for changes and additions. The value of the conducted research lies in the possibility of increasing the effectiveness of countering crimes in the field of illegal arms trafficking.
