The Set of Crimes When Committing Illegal Cultivation of Plants Containing Narcotic Drugs or Psychotropic Substances

The article indicates that the illegal cultivation of narcotic plants has an increased degree of public danger, since it threatens the health of the population, especially when selling raw materials in the form of narcotic plants and their parts, from which narcotic drugs are subsequently produced. Therefore, it is important to establish all crimes committed by persons involved in the illegal cultivation of narcotic plants, as well as the intent to commit other actions that are not covered by the objective side of Art. 231 of the Criminal Code of the Russian Federation. The paper draws conclusions about the need to carefully study: signs of the objective side of the illegal cultivation of narcotic plants; facts of their illegal cultivation and further disposal of grown drug-containing plants; committing illegal cultivation of narcotic plants at different times, but with their subsequent storage in one place; statute of limitations for the crime committed under Art. 231 of the Criminal Code of the Russian Federation. The provisions and conclusions are essential for legislative practice.
