The Protection of Whistleblowers in South African Criminal Law

Abstract
The purpose of this article is to consider such a participant in criminal proceedings in the law of South Africa as an informant or whistleblowers, to analyze the legislation of South Africa, during which the legal framework of the Republic of South Africa will be analyzed, namely the provisions relating directly to measures to ensure the safety of informants. This article also examines the actual situation and position of whistleblowers in South Africa, where the leading role is played by the political factor, and not the legal one. Based on the results of the study, the authors come to the conclusion that the legislation of the Republic of South Africa does not have adequate measures to ensure the protection of whistleblowers and other persons reporting any kind of offenses and crimes. The authors see a solution to this problem in the introduction of new legislation, or amendments to existing legislation concerning the legal regulation of the position of an informant as a participant in the criminal process of South Africa.
