AI Agents in Civil Law Proceedings: Influence on Legal Relations, Issues of their Lawful Use

Abstract

Because of the rapid development of artificial intelligence technology, tools based on it (including AI agents) are becoming increasingly important. These tools enable tasks that could previously only be performed by humans. The range of tasks that can be performed by AI agents includes those faced by participants in civil legal proceedings. Thus, AI agent technology implies the ability to autonomously perform actions similar to those authorized to participants in civil proceedings, making research on this topic relevant. The objectives of this study are to analyze the impact of AI agents on civil procedural relations and to examine the lawful application of AI agents in civil proceedings. Therefore, this article examines in detail the role of AI agents in civil proceedings, thereby demonstrating its scientific significance. Furthermore, the article also has practical significance: it outlines a possible lawful method for using AI agents based on current legislation. The study concluded that although AI agents are capable of de facto influencing legal relations, since they are not actors (including legal entities), this influence is not legally manifest. While the possibility of changing de jure legal relations is not excluded in the future, such an approach will face fundamental difficulties at the level of legal theory. Nevertheless, the lawful use of AI agents is still possible today.
