Contractual Regulation of Franchise Relations in Belgium

Abstract
The growing role of franchising as an effective tool for developing entrepreneurship in the context of globalization and increasing competition determines the relevance of considering the legal regulation of franchising relations using the example of Belgian legislation. The purpose of the study is to identify the features of the legal regime of franchising relations in Belgium. The purpose of the scientific research determines its tasks: consideration of the legal nature of the franchise agreement and the mechanisms of its regulation; identification of the regulation of the interaction of participants in franchising relations based on the norms of civil and commercial law. The scientific significance of the study is determined in the comprehensive approach to the analysis of the legal regulation of franchising in Belgium, identifying the specifics of the application of individual provisions of the legislation to franchising relations. The work makes the following main conclusions: firstly, franchising relations in Belgium are based on the norms of civil and commercial law, which are subject to significant reform in order to ensure the protection of the interests of the parties. Secondly, the main emphasis in regulation is given to the pre-contractual stage of franchising relations, aimed at establishing transparency of the relationship of its participants. Thirdly, the role in coordinating relations is strengthened by fixing the mechanisms of anti-competitive market practices. The conducted research will allow to establish clarity in compliance with legislative requirements by entrepreneurs, to determine the boundaries of imperative and optional regulation of franchising relations.
