On the Issue of the Legal Nature of Extinguishing Limitation

The relevance of the research topic is due to the insufficient theoretical elaboration of the category of extinguishing statute of limitations in the context of its widespread legislative application.

The purpose of the study is to determine the legal nature of the extinguishing statute of limitations. The objectives are: analysis of the proposed theoretical definition of extinguishing limitation; analysis of the signs of extinguishing limitation as a legal construct, as well as identification and disclosure of its elements.

The scientific significance of the work lies in the potential use of its results by scholars as a necessary foundation for further theoretical developments in the field of extinguishing limitation. The practical significance of the work lies in addressing many problematic issues related to the correct application of the extinguishing statute of limitations in practice, which can certainly be used by lawyers in their professional activities.

Based on the results of the conducted research, the author proposes a definition of extinguishing limitation; emphasizes the need to distinguish two main types of extinguishing statute of limitations: regulatory and protective; and analyzes the elements of the legislative structure of the regulatory extinguishing limitation of the exclusive right to a trademark.

The value of the presented research lies in the comprehensive actualization of the issues related to of extinguishing limitation as an important legal phenomenon with broad practical application.
