Transparency as a Sign of Abuse of Office

Abstract

The relevance of the research topic lies in the need for a clear definition of criteria for distinguishing abuse of official authority from acts that are not crimes. The criminal law, as one of the conditions for qualifying an act as an abuse of official authority, indicates the clearness of going beyond these powers, however, it is unclear from the text of the law what is meant by this clearness.
The scientific significance of the work lies in the study of legal doctrine and judicial practice on the qualification of abuse of office and a critical assessment of the need for the existence of a sign of "clarity" as a prerequisite for qualification under Article 286 of the Criminal Code of the Russian Federation. The practical significance lies in the potential opportunities for improving the law, investigative, prosecutorial and judicial practice and more effective fight against official crimes. The value of the conducted research lies in the analysis and critical assessment of the sign of "clarity", which has been studied very rarely separately in criminal law science to date.
The author comes to the conclusion that the use of the word "explicitly" and the conditions for "explicitly" going beyond the limits of official authority in the disposition of the norm of Part 1 of Article 286 of the Criminal Code of the Russian Federation is unnecessary. This contradicts the principles of equality, guilt, the presumption of innocence and the objectives of the criminal law.
